“CRUISE OUT OF THE COLD” CONTEST RULES
Official Contest Rules as of: Janurary 14, 2010
Saga Communications of Tuckessee, LLC, and its parent companies, which includes their members, officers, directors, and shareholders, are referred to collectively herein as WVVR/WZZP. WVVR/WZZP will conduct “CRUISE OUT OF THE COLD” (hereinafter referred to as “contest”), a radio promotion contest that will air January 18, 2010 to February 13, 2010 in which WVVR/WZZP listeners will have a chance to win a Caribbean Cruise package valued at no less the $2,090.00 (hereinafter referred to as the “Grand Prize”). This contest will be conducted on WVVR and WZZP with ONE GRAND PRIZE WINNER coming from those who register through WVVR and/or WZZP. RULES ARE SUBJECT TO CHANGE WITHOUT NOTICE. ALL QUALIFIERS MUST BE 18 YEARS OF AGE OR OLDER. ODDS OF WINNING DEPEND ON NUMBER FO QUALIFIERS. This contest is officially sponsored by Arby’s.
Qualifying Methodology:
No purchase is necessary to enter or win. To qualify to win through WVVR and WZZP, a listener may do one of the following:
1 – Log on to www.beaver1003.com or www.z975.com and register online. Online registration will begin on Monday, January 18, 2010 and end at 11:59pm on Saturday, February 13, 2010.
2 – Persons may also enter the contest by texting the designated keyword to the designated shortcode. The designated keyword and shortcode may be obtained at any Hopkinsville or Clarksville area Arby’s location. Registration via text will begin on Monday, January 18, 2010 and end at 11:59PM on Saturday, February 13, 2010. Message and data rates may apply.
Persons may have no more than one online entry per station and no more than one entry via text throughout the duration of the contest.
Grand Prize Details:
1 Caribbean Cruise for 2 ($2,090.00)
- Airfare for 2 (leaving together out of the same major U.S. airport) to Ft. Lauderdale Fl.
- A 2-night Caribbean Cruise for 2 to Nassau, Bahamas, aboard the MS Bahamas
Minimum of 45 days advanced notice is required. This does not apply to any incidental expenses, airport transfers, service charges, gratuities, port chargers or taxes, which are the responsibility of the traveler. Trip is non-transferable, cannot be redeemed for cash and has no cash value. Trip expires 1 year from issue date. This offer is not valid for groups (anyone attempting to travel with 2 or more gift certificates).
Final Selection Process:
On February 15, 2010, contest officials will conduct a random drawing from all entrants. The person whose name is selected will be deemed the grand prize winner. Grand Prize Winner may not transfer prize to another person.
If the Grand Prize Winner is deemed ineligible or refuses the Grand Prize, an alternate winner will be selected by conducting another random drawing.
This contest is open to Kentucky and Tennessee residents who hold a valid form of photo identification, and are 18 years of age or older at the time they sign up as a contestant. Employees of WVVR/WZZP, the above sponsors, advertising agencies, affiliates, employees of other radio stations, and members of their immediate families are not eligible.
WVVR/WZZP reserve the right to disqualify any entrant if these contest rules have been violated in any way.
By entering, each participant agrees that his or her voice, name, photograph, caricature and/or likeness may be used by WVVR/WZZP for promotional purposes. All qualifiers agree to provide WVVR/WZZP their name, address, phone number and Social Security Number. Failure to supply required information renders qualifier ineligible. This will ONLY be used for processing necessary information as it pertains to prizes. Prize winners agree to waive any claim of royalty, right of further remuneration for any such promotional use and agree not to appear on, or on behalf of, any other radio or television station within 50 miles of the WVVR/WZZP main studio for a period of six (6) months after acceptance of prize.
Grand Prize value (1099 Value) is: $2,090.00
All winners assume financial obligations for local, state and federal taxes and all applicable fees based on the value of the prize. In accordance with IRS regulations, any winner receiving a prize(s) valued at $600 or more in a given calendar year is furnished a copy of IRS Form 1099 (miscellaneous income).
No purchase is necessary to participate or win. This contest is void where prohibited by law. The Grand Prize is not transferable or redeemable for cash.
All prize not claimed by June 30, 2010 are forfeited and remain (or become) the sole property of WVVR/WZZP.
WVVR/WZZP shall have no responsibility for failure to win or claim any prize based on difficulties with telephone, facsimile, email, texting or internet difficulties, or any circumstances in the contest.
WVVR/WZZP, affiliates, participating sponsors, their agencies and the like, or any member thereof, make no claims of merchantability of Grand Prize. See manufacturer for complete warranty and operating instructions as it pertains to Grand Prize, if applicable.
Rules are subject to change without notice. Official contest rules are available at our 1640 Old Russellville Pike, Clarksville TN studios during regular business hours, on the Z975/WZZP website at www.z975.com and the Beaver 100.3 website at www.beaver1003.com and will air daily on WVVR/WZZP for the duration of the contest.
As licensees of the FCC and trustees of the public airwaves, WVVR/WZZP reserve the right to interrupt and/or discontinue any contest or promotion (and not award the offered prize) at the discretion of WVVR/WZZP management if world events, the national mood, or public safety so warrant.
GENERAL CONTEST RULES
1) No purchase is necessary to enter any WVVR or WZZP contest.
2) All contestants must be permanent residents of Tennessee or Kentucky and must provide WVVR/WZZP with a valid form of identification and Social Security number satisfactory to WVVR/WZZP management.
3) Subject to rule (4) below, all contestants must be at least 18 years old to be eligible to participate in contests that include hotel/motel accommodations, motor vehicles, boats, and/or air travel as prizes.
4) All contestants must be at least 21 years old to be eligible for all contests affiliated with an alcoholic beverage manufacturer or distributor.
5) One entry per household will be permitted to participate in a contest. A "household" is defined as any individuals residing at the same address. After winning a contest with a prize valued at $20 or more on WVVR or WZZP, the individual/household is ineligible to win any other contests on WVVR or WZZP for a period of thirty (30) days. All individuals/households receiving a prize valued at $600.00 or more on WVVR or WZZP may be issued a 1099 Federal Income Tax Form by WVVR or WZZP, and are ineligible to win a prize valued at $500.00 or more for a period of one calendar year from the date of winning. If it is determined that a selected contestant is ineligible as a result of one or both of these restrictions, another contestant will be selected. This selection procedure will continue until these restrictions are satisfied.
6) Anytime the WVVR or WZZP on-air studio is called, it is assumed by the caller that the phone call is being recorded and may be broadcast. The caller grants permission to WVVR or WZZP to broadcast the call or record the call for later broadcast.
6a) For telephone contests, listeners may enter by calling the phone number of the appropriate station. If any problems are discovered by WVVR or WZZP, different call-in numbers or addresses may be substituted and utilized after those numbers and addresses are broadcast on WVVR or WZZP. In the event a caller is disconnected during a contest before his/her name and phone number is recorded, then the prize will be awarded to the next caller whose name and phone number are recorded. The person operating the telephone at WVVR or WZZP has the final decision as to who is the winning caller. If you’re listening to the internet stream of this station, programming may be delayed affecting contest participation.
7) For contests requiring written entry forms, they may be faxed to 931-648-7769, e-mailed to a contest specific address on station websites, or mailed/delivered to WVVR/WZZP – 1640 Old Russellville Pike, Clarksville, TN 37043. All entries become property of WVVR or WZZP and will not be returned. WVVR or WZZP reserve the right to retain any or all contest materials for any reason that WVVR or WZZP deem necessary to the completion of the contest, or reasons relating to publicity and/or advertising. WVVR/WZZP shall have no responsibility for a contestant’s failure to win or claim any prize based on difficulties with telephone, facsimile, email, or internet difficulties, or any circumstances in any contest.
8) Any specific rules and/or restrictions pertaining to individual contests (entry dates, a limit on number or words on an entry, etc.) will be disclosed in on-air announcements.
9) Prizes must be picked up by the winners at the WVVR/WZZP business office or other pre-arranged or pre-announced location within thirty (30) days of notification to the winner, unless there is a deadline date by which the prizes must be picked up, in which case, that date will be specifically stated. Otherwise, failure to pick up the prizes by the deadline will result in the forfeiture of the prize, which shall remain the property of WVVR/WZZP. WVVR/WZZP assume no liability for the delivery of prizes.
10) In the event the winner is subject to, or the subject of, any order or legal process issued by any governmental agency having jurisdiction over the affairs of the winner (i.e. garnishment, child support order, judgment, lien, and the like), WVVR/WZZP delivery of the prize to the official representative of the governmental entity claiming a right to the prize shall be thus deemed as WVVR or WZZP awarding the prize to the winner. WVVR or WZZP shall be entitled to rely in good faith, upon any documents presented by the representative seeking to collect the prize in lieu of the winner. WVVR/WZZP shall not be liable for any claim by any winner for damages incidental thereto.
11) As a condition of entering a contest, contestants must agree that upon winning, they will consent to the use of their name, likeness, and all verbal and written communications with WVVR/WZZP for publicity purposes.
12) Employees of WVVR/WZZP, 5 Star Radio Group, (and its ultimate parent company, Saga Communications, Inc.), their advertising agencies, affiliates, contest sponsors, employees and immediate families of each, and employees of all media of mass communication within a one hundred mile radius of the WVVR/WZZP main studio are not eligible to win any contest.
13) All prizes are non-transferable and are not redeemable for cash. WVVR/WZZP reserve the right to substitute a prize of similar value. WVVR or WZZP cannot be held responsible for unforeseen cancellations or delays of concerts/events or transportation caused by weather, promoter or performer.
14) Winners are solely responsible for all applicable local, state and federal taxes. Winner may be issued a 1099 MISC federal tax form if in one calendar year the prize value of all prizes won in contests from WVVR or WZZP and/or participating cosponsors exceeds $600.00.
15) WVVR/WZZP, 5 Star Radio Group assumes no liability for liability, damages, situations, repairs, or incidents arising from any aspect of any prize awarded in any contest. WVVR/WZZP, 5 Star Radio Group, all participating co-sponsor companies and their advertising and promotional agencies, affiliates thereof, employees, and immediate families of each absolve themselves and shall be held harmless from any action or liability arising from any contest or prize awarded in any contest. As a condition of entering a contest, participants may be required, upon winning, to sign a release form and affidavit of eligibility to claim their prize. Failure to do so will result in forfeiture of the contestant’s right to claim or receive the prize.
16) The following are specifically related to E-contests and E-Mail Club promotions on station websites:
a) All appropriate information in required fields must be filled out or contestants will be disqualified.
b) To be eligible to win a prize, a contestant must reside within the listening area of WVVR or WZZP, as defined within the exclusive discretion of WVVR/WZZP management.
c) Any problems with the internet or email are not WVVR’s or WZZP’s responsibility.
d) Contestants who attempt to register to participate on WVVR’s or WZZP’s website may be required to produce a printed copy of proof of registration before being allowed to participate in the contest.
e) If you’re listening to the internet stream of a station, programming may be delayed affecting contest participation.
17) All giveaways and contests are void where prohibited by law. All local, state and federal regulations apply. As a licensee of the FCC and a trustee of the public airwaves, WVVR/WZZP reserve the right to interrupt and/or discontinue any contest or promotion (and not award the offered prize) at the discretion of WVVR/WZZP management if world events, the national mood, or public safety so warrant. WVVR/WZZP reserve the right to disqualify any winner if the contest rules have been violated in any way. WVVR/WZZP reserve the right to amend the rules to any contest at any time. All decisions of WVVR/WZZP are final.
18) Although WVVR/WZZP will make reasonable efforts to conduct its contests substantially as announced or advertised, WVVR/WZZP reserve the right in extraordinary situations to change or modify the rules of its contests as exigent circumstances may require. In such cases, WVVR/WZZP will amend the rules for that contest and broadcast the amended rules as promptly as possible. In such case, the contest will be conducted in accordance with the amended rules.
